Some HIPAA Background:

The American Recovery and Reinvestment Act of 2009 added an important amendment to HIPAA — the HITECH (Health Information Technology for Economic and Clinical Health) Act, which expanded the HIPAA Privacy, Security, and Enforcement rules that govern the release of electronic protected health information (ePHI) and the process of reporting information breaches. That was signed into law on March 26, 2013 with covered entities and business associates given 180 days to comply.

In the past, HIPAA rules targeted covered entities (CEs) such as hospitals, physicians, and direct healthcare providers, but now third-party business associates (BAs) are targeted as well. This means any vendor who handles or processes ePHI is now liable under the Omnibus Rule.
